01Acceptance of terms
By accessing or using the TrajectoryGEO website ("Site") or engaging us for services, you agree to be bound by these Terms of Service ("Terms"). If you are using the Site or our services on behalf of a company or other legal entity, you represent that you are authorized to bind that entity to these Terms, and "you" means that entity.
If you do not agree to these Terms, do not use the Site and do not engage us.
02Description of services
TrajectoryGEO offers generative engine optimization services, including but not limited to: AI citation audits, entity optimization, content strategy for answer engines, authority building, technical GEO, and AI visibility reporting. Specific deliverables, timelines, and scope are defined in the separate engagement agreement or statement of work that applies to each client.
We reserve the right to modify, suspend, or discontinue any part of our services at any time. For complimentary deliverables (such as the audit), we make no guarantee of continued availability.
03Your obligations
When you use the Site or engage our services, you agree to:
- Provide accurate, current, and complete information when submitting the audit intake form or communicating with us;
- Not use the Site or our services for any unlawful purpose or in any way that could damage, disable, or impair our systems or other users' experience;
- Not attempt to gain unauthorized access to any part of the Site, our systems, or the systems of our clients or service providers;
- Not scrape, crawl, reverse-engineer, or replicate any content, design, or methodology on the Site without written permission;
- Provide the access, information, and approvals reasonably required to deliver any engagement you retain us for;
- Comply with all applicable laws and regulations in connection with your use of our services.
04Intellectual property
Our content
All content on the Site — including text, design, graphics, logos, SVGs, code, methodologies, and brand elements — is owned by TrajectoryGEO or its licensors and protected by applicable copyright, trademark, and intellectual property laws. You may view the Site for your personal and business use. You may not copy, reproduce, distribute, modify, or create derivative works without our prior written consent.
Your content
You retain ownership of any content, data, or materials you provide to us. By submitting content through the intake form or during an engagement, you grant us a non-exclusive, royalty-free license to use that content solely for the purpose of delivering the services you requested.
Deliverables
For paid engagements, intellectual property ownership of client-specific deliverables is defined in the engagement agreement. In the absence of a separate agreement, deliverables produced specifically for a client transfer to that client upon full payment. Our underlying methodologies, templates, tools, and know-how remain our property.
05Fees & payment
The initial audit is offered as described on the Site. Ongoing services, retainers, and project engagements are priced separately and governed by a written statement of work or engagement letter. Payment terms, billing cycle, late-payment consequences, and any applicable taxes are set out in that agreement.
Unless otherwise agreed in writing, all fees are non-refundable once services have been performed.
06Confidentiality
We treat any non-public information you share with us — commercial, technical, or strategic — as confidential. We will not disclose your confidential information to third parties except as required to deliver the services, comply with the law, or with your express permission.
You agree that any non-public information we share with you during an engagement — including methodologies, pricing, or internal documentation — is likewise confidential and will not be shared without our express permission.
This mutual confidentiality obligation survives termination of any engagement.
07Disclaimers
The Site and our services are provided "as is" and "as available" without warranty of any kind, whether express, implied, or statutory. We make no representation or warranty that:
- The Site will be uninterrupted, secure, or error-free;
- Any specific result will be achieved (including but not limited to any specific level of AI citations, traffic, revenue, or pipeline);
- Our services will meet your particular requirements or expectations;
- Any information we provide will remain current or accurate as AI models, search engines, or third-party platforms change.
AI engine behavior, algorithms, and retrieval methods change frequently and without notice. Nothing in our audits, reports, or engagement deliverables constitutes a guarantee of future performance.
08Limitation of liability
To the maximum extent permitted by applicable law, TrajectoryGEO, its owners, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages — including but not limited to lost profits, lost revenue, lost data, or business interruption — arising from or related to your use of the Site or our services, even if we have been advised of the possibility of such damages.
Our total aggregate liability for any claim arising out of or relating to the Site or our services shall not exceed the greater of (a) the fees you have paid us in the twelve months preceding the claim, or (b) one hundred US dollars (USD $100).
Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of these limitations may not apply to you.
09Indemnification
You agree to defend, indemnify, and hold harmless TrajectoryGEO and its owners, employees, and affiliates from and against any claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including reasonable attorneys' fees) arising from (i) your use of and access to the Site or our services, (ii) your violation of these Terms, (iii) your violation of any third-party right, including any intellectual property or privacy right, or (iv) any content or information you provided to us that is inaccurate, unlawful, or infringing.
10Termination
We may suspend or terminate your access to the Site or our services at any time, without notice, for conduct that we reasonably believe violates these Terms or is harmful to other users, us, or third parties. Upon termination, all provisions of these Terms which by their nature should survive — including ownership, confidentiality, disclaimers, limitations of liability, and indemnification — shall survive.
11Governing law
These Terms are governed by the laws of the jurisdiction in which TrajectoryGEO is registered, without regard to its conflict-of-law principles. Any dispute arising from these Terms or your use of the Site or our services shall be brought exclusively in the competent courts of that jurisdiction, unless required by local law to be brought elsewhere.
If you are a consumer resident in the EU, you may also bring claims in your country of residence where required by mandatory law.
12Changes to terms
We may revise these Terms at any time. The "Last updated" date at the top of this page indicates when the Terms were last changed. For material revisions, we will provide prominent notice on the Site or via email where reasonable. Continued use of the Site or our services after a revision constitutes acceptance of the updated Terms.
